Welcome to Bongga Scrubs! These Terms of Use (the "Terms") are the rules for using our website at www.bonggascrubs.com, joining our waitlist, receiving our emails, and buying our products (together, the "Services"). Bongga Scrubs is owned and operated by Bongga Scrubs LLC, a California limited liability company ("Bongga Scrubs," "we," "us," or "our").

By using the Services or placing an order, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services. We've tried to keep this readable, but some parts are legal must-haves, so please give them a real read, especially sections 12 through 15, which limit our liability and explain how disputes are handled.

1. Who can use the Services

You must be at least 18 years old, or the age of majority where you live, to create an account or buy from us. If you use the Services on behalf of a business, you confirm you have the authority to agree to these Terms for that business.

2. Your account

You can browse and check out without an account. If you create one, please give us accurate information and keep it up to date. Keep your password private. You're responsible for activity under your account, so let us know right away at lthourk@bonggascrubs.com if you think someone else has used it. We may suspend or close accounts that break these Terms or that we reasonably believe are being used for fraud.

3. The waitlist and launch updates

Joining our waitlist means you'd like to hear from us about our launch. It doesn't reserve a product, guarantee availability or a price, or create an order. Launch dates, collections, colors, and details shown before launch, including sketches and sample photos, are previews and may change.

4. Orders

Placing an order. When you check out, you're offering to buy the items in your cart. Your order confirmation email means we've received your order, not that we've accepted it. We accept your order when we ship it.
If we can't fill an order. We may limit quantities or decline or cancel an order, for example if an item sells out, a price or description was listed in error, or we suspect fraud or resale. If we cancel after you've paid, we'll refund you in full for the canceled items.
Limited drops. Some collections are made in small batches. Adding an item to your cart doesn't hold it for you.
Shipping. Delivery dates are estimates. Once we hand your order to the carrier, the risk of loss passes to you, but if a package is lost or arrives damaged, contact us and we'll work with you and the carrier to make it right.
Returns and exchanges. Returns and exchanges follow the return policy posted on our site when you place your order.
Personal use only. Our products are sold for personal use. We may decline orders that look like they're meant for resale.

5. Prices, payment, and promo codes

Prices. Prices are in U.S. dollars and may change at any time before you complete checkout. Shipping and any applicable sales tax are added at checkout.
Payment. Our store runs on Shopify, which provides our checkout and payment processing. By paying, you authorize us and our payment providers to charge your chosen payment method for your order total, and you confirm you're allowed to use that payment method. Your payment details are handled by our payment providers under their own terms.
Promo codes. Promo codes and discounts have no cash value, can't be sold or transferred, may be limited to one use per customer, and may expire or end at any time. Promotions may have their own rules, which we'll share with the offer.

6. Product colors, sizing, and descriptions

We work hard to show our products accurately, but colors can look different on different screens, and sizing and fit vary from person to person. Please check our size information before you order. Small differences in color, print placement, or trim from what you see online are a normal part of making apparel and are not a defect.

7. Our scrubs are apparel, not protective equipment

Bongga Scrubs makes fashionable, functional work apparel. Unless a product page specifically says otherwise, our products are not personal protective equipment (PPE) or medical devices, and they are not designed or certified to protect against fluids, chemicals, fire, radiation, or infection. Always follow your workplace's dress code, uniform, and safety requirements. Please follow the care instructions on each product's label.

8. Our content and brand

Everything on our site and in our emails, including the Bongga Scrubs name and logo, our designs, illustrations, photos, text, and patterns, belongs to Bongga Scrubs or the people who licensed it to us, and is protected by copyright, trademark, and other laws. You're welcome to view and share our content for personal, non-commercial purposes, like sending a friend a link or reposting our TikTok, but you may not copy our designs or use our name, logo, or content to sell products or suggest you're affiliated with us without our written permission.

9. What you share with us

We love seeing you in Bongga. If you post a review, send us a photo, or tag or mention us on social media, you confirm that it's yours to share and that it doesn't violate anyone else's rights. You give us a non-exclusive, royalty-free, worldwide permission to use, share, and display that content, along with your username, on our site, social media, emails, and marketing. Before we feature a photo of you in an ad, we'll ask your permission first. If you'd like us to take down something we've shared, email us and we'll remove it from our channels within a reasonable time.

You also agree not to post anything that's unlawful, hateful, harassing, misleading, or that includes someone else's private or confidential information, including any patient information. We may remove content at our discretion.

10. Using the Services the right way

Please don't:

Use the Services for anything illegal, fraudulent, or harmful.
Try to hack, disrupt, overload, or get into parts of the site you aren't meant to access.
Use bots, scrapers, or other automated tools to collect content or data, or to buy products in bulk.
Upload viruses or other harmful code.
Pretend to be someone else, or misrepresent your connection to Bongga Scrubs.
Use our Services to send spam or harass anyone.

11. Feedback and ideas

We'd love your ideas about new colors, pockets, fits, and anything else. If you send us feedback or suggestions, we're free to use them to improve our products and Services without paying you or crediting you, and we don't have to keep them confidential.

12. Disclaimer

To the fullest extent allowed by law, the Services and all content on them are provided "as is" and "as available." Except for any warranty stated on a product page or in our return policy, we do not make other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we don't promise the site will always be available or error-free. Some states don't allow these kinds of disclaimers, so they may not all apply to you, and nothing in these Terms limits rights you have under consumer protection laws that can't be waived.

13. Limitation of liability

To the fullest extent allowed by law, Bongga Scrubs and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services or our products. Our total liability for any claim related to the Services or our products is limited to the greater of the amount you paid for the product(s) involved or $50. These limits don't apply where the law doesn't allow them, including for liability that can't be limited for fraud, gross negligence, or intentional misconduct.

14. Indemnification

If you break these Terms, violate the law, or infringe someone else's rights, and that leads to a claim against Bongga Scrubs by someone else, you agree to cover our reasonable costs of dealing with that claim, including reasonable attorneys' fees, to the extent allowed by law.

15. Resolving disputes

Talk to us first. Most problems can be fixed with a quick conversation. If you have a concern, please email lthourk@bonggascrubs.com with your name, order number (if you have one), and a description of the issue. We'll both try in good faith to resolve it within 30 days before taking any formal action.

Governing law and courts. These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. If we can't resolve a dispute informally, either of us may bring an individual claim in small claims court if it qualifies. Otherwise, disputes will be handled in the state or federal courts located in San Diego County, California, and we both agree to those courts' jurisdiction, except where the law where you live gives you the right to bring a claim in your local courts.

California consumer notice. Under California Civil Code Section 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Our Services may link to other websites and apps, like TikTok, Instagram, or shipping carriers. We don't control them and aren't responsible for their content, products, or privacy practices. Their own terms and policies apply when you use them.
